Spouse changing the lock on a storage unit that doesn’t have his name on lease after divorce filing?
I’m really getting sick of this idiot. Anyway, my sister recently filed for divorce against her husband. Just a few days ago he changed the lock on her storage unit that has only her stuff in it and is in her name. It also has some of my stuff in it by chance. Is there anything that can be done?
Well, it’s in a small town. The owner knows them, even though it was in her name he might have just figured, “her husband.” He could have said anything to the owner. Or maybe he got a hold of the key. Regardless, legally it was in her name and she paid the rent.
Anyway, I just got off the phone with her, and she’s calling the police. Thanks for all the advice, everybody. Anything else she should know or heed?
Unless he’s got a court order, or its California, basically the unit owner controls the unit. So cutting off the lock and replacing it is one option.
Personally if its in my name and there’s no marital property in the unit, I’d cut the lock and move everything to a new storage facility.
The property owner who rented the unit may not have liability because most storage rental contracts have a hold-harmless clause that says if a thief broke in and stole your stuff, they have no liability even if they let the thief steal it.
